Terms of Service – sellawine.com

Last updated: October 24, 2026

1. Operator and Scope

These Terms of Service ("Terms") govern access to and use of sellawine.com (the "Platform"), operated by:

Jaeger Digital Labs
Büelstrasse 39
8132 Hinteregg
Switzerland
Email: info@sellawine.com

By accessing, registering for, or using the Platform, users agree to these Terms. Users who do not accept these Terms must refrain from using the Platform.

These Terms apply to all visitors, private sellers, buyers, wine merchants, professional traders and other users, regardless of their country of residence.

2. Nature of the Platform

sellawine.com is an online classified advertising and information platform that enables users to advertise, discover and communicate about wines, spirits, wine-related accessories and other permitted products.

sellawine.com is solely a technical intermediary and advertising platform. It is not a wine retailer, dealer, auctioneer, broker, commercial agent, payment provider, escrow provider, insurer or party to transactions between users.

In particular, unless explicitly agreed otherwise in a separate written agreement, the Platform:

  • Does not own, purchase, possess or sell products advertised by users.
  • Does not conclude sales contracts on behalf of users.
  • Does not collect, receive, hold or process purchase payments between buyers and sellers.
  • Does not provide escrow, buyer protection or transaction guarantees.
  • Does not arrange or guarantee shipping, customs clearance, storage or delivery.
  • Does not physically inspect, authenticate, certify or insure advertised products.
  • Does not guarantee the identity, reliability, licensing or solvency of users.
  • Does not guarantee that advertised products may legally be purchased, sold, exported or imported in a particular jurisdiction.

All transactions are negotiated and concluded directly between the respective users. Any contractual relationship arising from a transaction exists exclusively between the buyer and seller.

sellawine.com assumes no responsibility for the performance, validity, legality or enforcement of such contracts.

3. Eligibility and Age Restrictions

The Platform is intended exclusively for adults aged 18 years or older.

By using the Platform, users represent and warrant that they:

  • Are at least 18 years old.
  • Have the legal capacity to enter into binding agreements.
  • Are legally permitted to purchase, possess, advertise or sell the relevant products in their jurisdiction.
  • Will comply with all applicable alcohol, consumer protection, licensing, advertising and trade regulations.

The legal minimum age for purchasing or receiving alcoholic beverages may vary between jurisdictions and product categories. Users must comply with the stricter applicable requirements.

Sellers bear exclusive responsibility for implementing legally required age verification procedures before supplying alcoholic beverages, including at the point of delivery or collection where required.

The Platform may introduce age verification mechanisms, restrict access or suspend users where necessary or appropriate. Any verification conducted by the Platform does not relieve sellers of their legal obligations.

4. Registration and User Accounts

Certain Platform functions require registration. Users must provide accurate, current and complete information and keep their account details updated.

Users are responsible for maintaining the confidentiality of their login credentials and for all activities conducted through their accounts, except to the extent applicable law provides otherwise.

Users must immediately inform the Platform of suspected unauthorized access or misuse.

The Platform may refuse registrations, suspend accounts, impose restrictions or terminate access where reasonably necessary to address suspected violations, fraud, security threats or legal obligations, subject to applicable law.

No user has an unconditional entitlement to account registration, continued publication or uninterrupted access.

5. Listings and Seller Responsibilities

Users publishing advertisements are solely responsible for their content, accuracy, legality and completeness.

Sellers represent and warrant that:

  • They legally own the advertised products or are authorized to sell them.
  • The products are genuine, lawfully obtained and legally marketable.
  • All information regarding producer, vintage, origin, appellation, bottle size, condition, authenticity and price is accurate and not misleading.
  • They disclose material defects, damage, storage problems, damaged seals, leakage, unusual fill levels and known provenance concerns.
  • All required licenses, registrations and authorizations have been obtained.
  • They comply with applicable taxes, duties, alcohol regulations, product regulations and consumer protection laws.
  • They possess all necessary rights to photographs, descriptions, trademarks and other uploaded content.

Advertisements for counterfeit, stolen, illegally imported, unlawfully marketed, adulterated, unsafe or otherwise prohibited products are strictly forbidden.

Listings must not contain fraudulent claims, misleading prices, unauthorized commercial advertising, malicious links or content that violates third-party rights.

sellawine.com has no general obligation to pre-approve or independently verify every advertisement, except where required by applicable law.

The Platform may review, correct, restrict or remove listings in accordance with applicable law and its content moderation policies.

6. Artificial Intelligence and Wine Valuations

The Platform may provide artificial intelligence tools for wine identification, image recognition, automatic listing generation, estimated market valuations, descriptions, classifications and other informational services.

All AI-generated results, including valuations, are indicative estimates only and do not constitute professional appraisals, authentication certificates, binding offers, investment advice or guarantees.

AI-generated information may be incomplete, outdated, inaccurate or incorrect. In particular:

  • Wines may be incorrectly identified.
  • Producer names, vintages, appellations and classifications may be inaccurate.
  • Market prices may differ materially from estimated values.
  • Price estimates may not reflect actual executable transactions or current market liquidity.
  • Storage conditions, authenticity, provenance and bottle condition may not be reliably determined from photographs.
  • Automatically generated descriptions may contain factual errors.

Users are responsible for reviewing and correcting AI-generated content before publication or relying on it for commercial decisions.

Automated photograph analysis, label recognition or other technical checks do not amount to physical authentication or certification of the contents, authenticity, safety, origin or condition of any bottle.

Users must independently verify all information relevant to a transaction.

To the maximum extent permitted by applicable law, the Platform accepts no liability for financial losses, incorrect pricing decisions, failed transactions or other damages arising from reliance on AI-generated information.

7. Transactions Between Users

All negotiations, agreements, payments, deliveries, returns and disputes relating to advertised products are the exclusive responsibility of the participating users.

sellawine.com does not guarantee:

  • That a buyer will pay or a seller will deliver.
  • That advertised products exist or are available.
  • That products match their descriptions or photographs.
  • That any bottle is authentic, properly stored or suitable for consumption.
  • That shipments arrive safely, on time or at all.
  • That a user complies with contractual or statutory obligations.
  • That any transaction is financially secure or free from fraud.

Buyers are responsible for exercising appropriate due diligence, including reviewing product condition, provenance, seller identity and applicable legal requirements.

Users are encouraged to use reputable payment methods, suitable insurance, reliable transport services and professional authentication for valuable bottles.

The Platform is not responsible for refunds, cancellations, chargebacks, warranty claims or contractual disputes between users.

Any statutory consumer rights or mandatory obligations arising from a transaction remain enforceable against the party legally responsible for them.

8. Alcohol Regulations, International Trade and Taxes

The advertisement, sale, possession, transportation, importation and exportation of alcoholic beverages are subject to different laws and restrictions around the world.

Each user is solely responsible for determining whether a proposed transaction is lawful and for complying with all applicable requirements.

Such requirements may include:

  • Minimum purchasing and drinking ages.
  • Alcohol trading licenses and commercial registrations.
  • Restrictions on private or cross-border alcohol sales.
  • Customs declarations, import and export permits.
  • Excise duties, value-added taxes, sales taxes and other charges.
  • Alcohol advertising, labeling and marketing restrictions.
  • Age verification upon purchase, collection or delivery.
  • Shipping, storage and transport requirements.
  • Sanctions, embargoes and restrictions on international trade.

Users must not advertise, purchase, sell or ship alcoholic products where doing so would violate applicable law.

Unless otherwise required by applicable law, the Platform is not responsible for customs seizures, confiscations, fines, import restrictions, unpaid taxes, denied deliveries or penalties arising from transactions between users.

Availability of a listing in a particular country does not constitute confirmation that the product may legally be sold or delivered there.

9. Professional Merchants and Business Accounts

Professional merchants are solely responsible for operating their businesses in accordance with applicable law.

They must provide any legally required business identification, registration, licensing, contact, pricing, consumer protection and tax information.

The Platform may offer merchant profiles, business verification badges, promotional tools, website widgets and other functionality.

Any merchant verification or badge reflects only the specific checks performed by the Platform. It does not constitute an endorsement, financial guarantee, comprehensive background investigation, product authentication or certification of compliance with all laws.

Merchants remain fully responsible for their advertisements, products, commercial representations and transactions.

Where the Platform provides embeddable widgets or other technical tools, these are offered subject to availability and may be modified or discontinued. The Platform does not guarantee compatibility with third-party websites or software.

10. Fees and Platform Availability

Unless expressly stated otherwise, ordinary use of the Platform and publication of standard listings are provided free of charge.

The Platform may introduce optional premium services or paid features in the future. Applicable prices and payment conditions will be disclosed before a user purchases such services.

Free services may be modified, restricted, suspended or discontinued, subject to applicable legal obligations.

The Platform does not guarantee any minimum number of views, inquiries, buyers, transactions or sales.

11. Prohibited Conduct

Users must not:

  • Engage in fraud, identity theft, money laundering or unlawful commercial activity.
  • Advertise counterfeit, stolen or otherwise illegal goods.
  • Attempt to sell alcohol to persons below the applicable legal minimum age.
  • Misrepresent product provenance, authenticity, storage conditions or value.
  • Impersonate another person or business.
  • Distribute spam, malware, phishing links or unsolicited mass communications.
  • Collect personal information from other users unlawfully.
  • Manipulate reviews, ratings, merchant verification or user reputation systems.
  • Access accounts or technical systems without authorization.
  • Interfere with Platform functionality, security or availability.
  • Use automated scraping, harvesting or excessive automated requests without authorization.
  • Infringe copyrights, trademarks, privacy rights or other third-party rights.

Violations may result in removal of content, restricted access, account suspension or termination and, where appropriate, reporting to competent authorities.

12. User-Generated Content and Intellectual Property

Users retain ownership of intellectual property rights in content they lawfully upload.

By submitting content, users grant Jaeger Digital Labs a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, format, translate, adapt, display, distribute and technically process such content as reasonably necessary to operate, maintain, promote and improve the Platform and its services.

This includes displaying listings in search results, merchant profiles, promotional placements and authorized embedded widgets.

The license continues for as long as reasonably necessary for these purposes, subject to applicable privacy and intellectual property laws. Users may request removal of content in accordance with applicable law.

Users warrant that their content does not infringe third-party rights.

The Platform's software, branding, design, databases and other proprietary materials remain the property of Jaeger Digital Labs or their respective rights holders.

13. Content Moderation and Reporting

Users and third parties may report suspected illegal listings, fraudulent activity, intellectual property violations or other breaches of these Terms by contacting:

info@sellawine.com

Reports should identify the relevant listing or content, provide a clear explanation of the alleged violation and include supporting information where available.

The Platform may investigate reports and take appropriate measures, including removing content, restricting visibility, issuing warnings or suspending accounts.

Where required by applicable law, the Platform will provide relevant explanations, complaint-handling procedures and opportunities to contest moderation decisions.

Nothing in these Terms limits legally mandated reporting mechanisms, rights of appeal or obligations under applicable digital services legislation.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM AND ALL RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY.

Jaeger Digital Labs expressly disclaims, to the extent legally permissible, all warranties concerning:

  • Accuracy, completeness and reliability of listings or user information.
  • Authenticity, origin, provenance, quality, condition, merchantability or fitness of advertised products.
  • Accuracy or commercial usefulness of AI-generated valuations or descriptions.
  • Identity, trustworthiness or legal compliance of buyers and sellers.
  • Availability, uptime, functionality, security or uninterrupted operation.
  • Absence of software defects, errors, vulnerabilities or third-party interference.
  • Successful completion or financial security of transactions.
  • Preservation of uploaded content, communications or other data.

No statement, recommendation, verification badge, technical check or other information made available through the Platform creates a warranty unless expressly required by law.

15. Exclusion and Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JAEGER DIGITAL LABS, ITS OWNERS, EMPLOYEES, REPRESENTATIVES, CONTRACTORS AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY LOSSES OR DAMAGES ARISING FROM OR RELATED TO THE USE OF THE PLATFORM OR TRANSACTIONS BETWEEN USERS.

This exclusion includes, without limitation:

  • Fraud, scams, misrepresentation or unlawful conduct by third parties.
  • Counterfeit, stolen, adulterated, damaged or improperly stored wines or spirits.
  • Incorrect wine identification, AI-generated descriptions or market valuations.
  • Financial losses resulting from purchases, sales, negotiations or pricing decisions.
  • Non-payment, chargebacks, non-delivery or breach of contract between users.
  • Shipping damage, breakage, deterioration, loss, theft or transportation delays.
  • Customs problems, import or export restrictions, taxes, duties and regulatory penalties attributable to users.
  • Unauthorized access, phishing, malware or other third-party cyberattacks.
  • Interruptions, system failures, technical errors or loss of data.
  • Removal of listings, account restrictions or interruption of services where lawfully undertaken.
  • Actions or omissions of external service providers or third-party websites.

To the maximum extent permitted by law, Jaeger Digital Labs shall not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost revenue, lost business opportunities, reputational damage or loss of anticipated savings.

Where liability cannot be excluded entirely but may lawfully be limited, the total aggregate liability of Jaeger Digital Labs arising out of or relating to the Platform shall be limited to the greater of (a) CHF 50 or (b) the amount actually paid by the claimant to Jaeger Digital Labs for the relevant Platform services during the preceding twelve months.

These exclusions and limitations apply regardless of the legal basis of a claim, including contract, tort or other grounds, to the extent permitted by law.

Nothing in these Terms excludes or limits liability for unlawful intent, gross negligence or other matters for which liability cannot lawfully be excluded or limited, including mandatory consumer rights and other non-waivable statutory protections.

16. Release from User-to-User Disputes

To the extent permitted by applicable law, users agree that any dispute arising from a transaction between users must be resolved directly between the relevant parties.

Users release Jaeger Digital Labs from claims, demands and damages arising solely from the acts or omissions of other users, except where Jaeger Digital Labs bears independent liability under mandatory applicable law.

The Platform is under no contractual obligation to mediate disputes, recover payments, arrange refunds, enforce sales contracts or provide compensation for unsuccessful transactions.

The Platform may voluntarily assist with dispute resolution without assuming responsibility for the underlying transaction.

17. Indemnification

To the extent permitted by applicable law, users agree to indemnify and hold harmless Jaeger Digital Labs, its owners, employees and representatives against third-party claims, liabilities, damages, losses and reasonable legal expenses arising from:

  • The user's unlawful activities or violation of these Terms.
  • Misleading, fraudulent or unlawful listings.
  • Infringement of intellectual property, privacy or other third-party rights.
  • Non-compliance with applicable alcohol trading, licensing, tax, customs or consumer protection legislation.
  • Products sold, delivered or supplied by the user.
  • The user's breach of contractual obligations toward other users.

This indemnification does not apply to the extent a claim arises from the Platform operator's own unlawful conduct or liability that cannot be transferred or excluded under applicable law.

18. Third-Party Services and External Links

The Platform may contain links, advertisements, integrations, payment recommendations, merchant websites and third-party services.

These services are operated independently and may be governed by separate terms and privacy policies.

Jaeger Digital Labs does not control or guarantee third-party services and accepts no responsibility for their content, availability, security or performance except where mandatory law requires otherwise.

Users engage external payment providers, carriers, insurers and other service providers at their own discretion and risk.

19. Privacy and Data Protection

The collection and processing of personal data are described in the Platform's Privacy Policy, available at:

https://sellawine.com/privacy

Users must comply with applicable privacy and data protection laws when collecting or processing personal information obtained through the Platform.

Users must not exploit contact information, messages or account details for unlawful marketing, harassment, unsolicited communications or other unauthorized purposes.

20. Suspension, Termination and Service Changes

Jaeger Digital Labs may modify, suspend or discontinue Platform features or services for legitimate operational, technical, security, legal or commercial reasons, subject to applicable law.

Accounts may be suspended or terminated in accordance with these Terms and applicable legal requirements, particularly in cases of suspected fraud, illegal listings, security risks or repeated violations.

Users may discontinue use of the Platform and request account deletion, subject to applicable record retention obligations.

To the extent permitted by law, the Platform shall not be liable for losses resulting from lawful changes, suspensions or discontinuation of services.

21. Changes to These Terms

Jaeger Digital Labs reserves the right to amend these Terms to reflect changes in its services, business operations, legal obligations or security requirements.

Material changes will be communicated through the Platform or by other appropriate means where legally required.

Updated Terms will take effect on the stated effective date, subject to mandatory notice, consent and consumer protection requirements.

Continued use of the Platform after the effective date constitutes acceptance of revised Terms only where such acceptance is valid under applicable law.

22. Governing Law and Jurisdiction

These Terms are governed by the substantive laws of Switzerland, excluding conflict-of-law principles to the extent legally permissible.

To the extent permitted by applicable law, the competent courts of Zurich, Switzerland, shall have exclusive jurisdiction over disputes relating to these Terms or the Platform.

For consumers, this choice of law and jurisdiction does not deprive them of mandatory rights or protections afforded by the laws or courts of their habitual place of residence where such protections apply.

23. Severability and Entire Agreement

If any provision of these Terms is found invalid, unlawful or unenforceable, the remaining provisions shall remain effective to the extent legally possible.

Any invalid provision shall be interpreted or replaced, where permissible, in a manner that most closely reflects its intended lawful purpose.

These Terms constitute the general agreement between users and Jaeger Digital Labs regarding use of the Platform, subject to additional applicable service-specific agreements and mandatory statutory rights.

Failure to enforce any provision does not constitute a waiver of the right to enforce it later.
